MINUTES OF THE SPECIAL MEETING
OF THE CITY COUNCIL
OF THE CITY OF DES PLAINES, ILLINOIS
HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS,
DES PLAINES CIVIC CENTER,
MONDAY, APRIL 30, 2007

CALL TO ORDER: The Special meeting of the City Council of the City of Des Plaines, Illinois, was called to order by Mayor Anthony W. Arredia at 7:00 p.m. in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center on Monday, April 30, 2007.

ROLL CALL: Roll call indicated the following aldermen present: Beauvais, Christiansen, Murphy, Sayad, Brookman, Becker, Smith, Argus.

Also present was City Manager Niemeyer.

EXECUTIVE SESSION:

Moved by Murphy, seconded by Brookman, to go into Executive Session to discuss personnel. Upon roll call, the vote was:

AYES: 8-Beauvais, Christiansen, Murphy, Sayad,

Brookman, Becker, Smith, Argus

NAYS: 0-None

ABSENT: 0-None

Motion declared carried.

The City Council recessed at 7:01 p.m.

The City Council reconvened at 9:00 p.m.

Roll call indicated the following aldermen present; Beauvais, Christiansen, Murphy, Sayad, Brookman, Becker, Smith, Argus.

PERSONNEL/EVALUATION OF CITY MANAGER:

Moved by Murphy, seconded by Sayad, to concur with majority agreement in Executive Session that Mayor be authorized to proceed as directed regarding the evaluation of the City Manager. Motion declared carried.

AMENDMENT/TELECOMMUNICATION TAX ORDINANCE:

Ordinance M-22-07

Moved by Becker, seconded by Christiansen, to concur with Staff recommendation to amend Title 4, Chapter 3, Article 1 - "Municipal Telecommunications Tax" to revise the City Code as required by the Illinois Department of Revenue to comply with recent changes made by Public Acts 92-878, 93-2986 and 94-793; these are housekeeping changes which do not change the intent, rate or impact of the tax; and further recommend to place on First Reading Ordinance M—22-07 - Version 2, AN ORDINANCE ENACTING AND INCORPORATING THE SIMPLIFIED MUNICIPAL TELECOMMUNICATIONS TAX ACT BY REFERENCE AS TITLE 4, "BUSINESS REGULATIONS," CHAPTER 3, "MUNICIPAL OCCUPATION TAXES," ARTICLE 1, "SIMPLIFIED MUNICIPAL TELECOMMUNICATIONS TAX" OF THE DES PLAINES CITY CODE.

Alderman Sayad stated that these changes were not part of the discussion when this matter was first presented to the aldermen for consideration; it should go back to committee.

Moved by Sayad, seconded by Argus, to adopt a substitute motion that the amendment to the Telecommunications Tax ordinance be referred back to committee for further review. MOTION DECLARED FAILED (Aldermen Murphy, Sayad, Brookman and Argus voted yes; Aldermen Beauvais, Christiansen, Becker and Smith voted no - a tie vote is a failed vote).

Motion declared carried on the original motion (Aldermen Beauvais, Christiansen, Becker, Smith and Mayor Arredia voted yes; Aldermen Murphy, Sayad, Brookman and Argus voted no).

Further action on this matter under Unfinished Business on May 7, 2007.

ADJOURNMENT:

Moved by Sayad, seconded by Becker, that the Special meeting of the City Council adjourn. Motion declared carried. Meeting adjourned at 9:07 a.m.
